Millville council approves subdivision, but with strings attached

MILLVILLE -- The City Council approved a minor subdivision at 580 E. 300 South at Thursday's meeting, but will withhold building permits until the property owner deeds land to the city.

After bouncing between council and planning commission meetings for more than two months, Shirley Nelson met the city's request to donate land to the city in order to make a conforming lot.

Nelson said she would donate two pieces of land at the end of the subdivision so the city could straighten an existing road. According to a planning commission report, the city will use the extra land to make a 66-foot turn-around for easier snow removal.

Nelson said she would give the land to the city only as long as the homeowners still get right of way.

Councilman Mike Johnson moved to withhold any building permits, on any of the subdivided parcels, until required land dedication has been recorded with the county.

Nelson said the title company is working on the final steps to deed the land to the city.

The council meeting was almost dismissed for lack of a quorum, and Nelson would have had to wait another two weeks for approval. The third council member needed for a quorum didn't show up until 30 minutes after the meeting was to begin.

The meeting was later closed so the council could discuss pending litigation.
