sentencing rescheduled

November 10, 2005 | LOGAN -- A defendant's
sentencing was delayed Monday after a continuance of
60 days was granted for a behavioral evaluation.
Eric Castro-Ruiz, 19, of Logan pleaded guilty Sept.
26 to aggravated assault, a third-degree felony, and
possession of a controlled substance, a third-degree
felony.
Castro-Ruiz's attorney, Bryan Galloway, said, "I know
Eric fairly well. He's an interesting kid. He's pretty
positive." Galloway asked Judge Gordon Low for a continuance
for 60 days to complete an evaluation because he said
he's not sure what makes Castro-Ruiz "tick."
Judge Low agreed and said, "It's not a bad suggestion."
Galloway said "I honestly don't know if it's a life
skills problem, a drug problem, or if he's simply someone
who can't obey the law." He said with the evaluation,
hopefully he can figure that out.
The sentencing was rescheduled for 1:30 p.m. Jan.
9 in order for the evaluation to occur at the Utah Department
of Corrections.
