Hyde Park approves two subdivisions

April 10, 2008 | HYDE PARK ­ It was déjà vu in Hyde Park Tuesday night as the city council approved two subdivision final plats back-to-back. The approvals included matching contingencies that the respective development agreements be finalized before building begins.

The Cedar Springs subdivision was passed by a 4-0 vote with councilman Brent Kelly abstaining.

"I'm going to abstain on this one," said Kelly, who joined the meeting by conference call. "I could not hear all of the conversation."

The turn for Mountain Gate subdivision phases II and III came next. The council passed the Mountain Gate final plat by 3-2 vote.

Kelly was again in the minority and cited insufficient time to review the final plat as his reason for voting against approval.

"This particular addition adds maybe 5 to 7 percent additional homes to the city," said Kelly. "Given that I just got this about four hours ago, I'm a little hesitant to move forward on this, personally."

Each subdivision will now be required to finalize a development agreement. Development agreements contain information relating to applicant financing, maximum height and size of buildings, permitted uses of property, and dedication of land for public use, among other things.

The development agreement for Mountain Gate must be reviewed by each councilman and pass with majority consent. Those reviews are not required to take place in a public meeting, although each councilman put down a signature for their vote.
