Hyde Park P&Z denies rezone of A-1 acreage

April 4, 2008 | HYDE PARK -- Approximately 40 residents, feeling their way of life was under attack, are breathing easier today after a request to rezone 6.16 acres was denied by the Hyde Park Planning and Zoning Commission.

The rezone would change the classification of the land near 800 South 100 West from A-1, which requires lots be at least one acre, to RE-20, which allows lots to be sized down to 12,000 square feet in a planned residential subdivision with preserved open space. There are 43,560 square feet in an acre.

"We don't mind you developing," said Nancy Buckway, one of the residents in attendance, "but not in our A-1 zone."

The motion to deny Mike Cooper's rezone, requested by commissioner Judy Hawkins, was upheld by a 3-2 vote, after a previous motion to extend discussion to the next meeting failed by 2-3.

"The city's responsibility is to those who already live here," said Hawkins.

The residents in attendance broke into applause following commissioner David James' announcement of the rezone's denial. Mostly due to the noise, the meeting took an unofficial recess of approximately 15 minutes before resuming city business.

The commission later voted unanimously to send two phases of Shane Traveller's Mountain Gate subdivision on to the next City Council meeting, which will be April 8.

"As far as I can tell it fits what we need," said commission alternate Mark Hurd.
